Fintech Market Entry in Argentina
Legal support for foreign payment, crypto and lending businesses entering Argentina. We help you assess the rules, plan registrations and coordinate the legal work for launch.
Start with a brief description. You do not need to know which registration applies.
In brief
Argentina has no single fintech license: the registrations a product needs depend on what it actually does. Jarsun, Ferreira & Calvo advises foreign payment, crypto and lending businesses entering Argentina, assessing the applicable BCRA, CNV and UIF frameworks, planning PSP, PSAV and non-bank lending registrations, including OPNFC where relevant, and coordinating the corporate and compliance work needed to launch.
If you prefer to start with the regulatory framework, read the Fintech Regulation in Argentina guide. This page describes the engagement itself.
When This Service May Fit Your Project
- a.You plan to offer payment accounts, wallets, acquiring services or payment infrastructure.
- b.Your business provides crypto or virtual-asset services and plans to serve Argentine customers.
- c.You intend to lend using your own funds or operate a lending platform.
- d.Your product combines several activities and you need to understand the Argentine requirements before committing to a launch structure.
We begin with the activities, customers, funds and assets involved in the proposed operation. This helps define the legal work for your particular business model.
Defining the Scope of Work
Assessing the applicable rules
Review the proposed activities against the relevant BCRA, CNV and UIF frameworks, and identify the registrations and obligations that may apply.
Planning registrations
Identify the relevant payment service provider (PSP), virtual asset service provider (PSAV), non-bank lending requirements, including OPNFC where applicable, or a combination of frameworks. Define the order of work and the dependencies between them.
Coordinating the corporate structure
Align the entity and ownership work with the intended activities and regulatory requirements. Company formation can be included as a separately defined engagement: see our company formation service.
Preparing the product and compliance work
Review the legal aspects of product flows, customer terms and anti-money laundering and customer-identification arrangements, within the agreed scope.
The proposal identifies the work JFC will handle, the deliverables and the participation needed from your team or other providers. If the required registration is already clear, explore our services for PSP registration, PSAV registration and non-bank lending regulation.
What the Engagement Delivers
Depending on the agreed stages, the deliverables may include:
- a.A written assessment of the rules relevant to your proposed activities and the questions that need to be resolved.
- b.A registration and launch plan showing dependencies, responsibilities and required information.
- c.A corporate coordination outline identifying the entity and ownership work needed for the project.
- d.An assessment of the legal and compliance documents required, with drafting or adaptation where included in the engagement.
The proposal specifies whether preparation and submission of registration applications, responses to regulator queries and continuing compliance support are included or handled as separate stages.
What We Need to Understand Your Project
Start with a description of the product, its customers, the countries where you operate and how money or assets move through the service. It also helps to know whether you already have an Argentine entity, local partners or an intended launch date.
Existing policies, corporate documents and technical materials can be reviewed later, once the required work is defined. A brief initial outline is enough to begin the conversation.
Planning the Launch
Corporate setup, regulatory applications, compliance preparation and banking arrangements have different dependencies. Some tasks can proceed in parallel; others require an earlier decision, document or approval.
We assess those dependencies when defining the work and distinguish preparation, filing and completion of each required step. Any estimated timeline identifies its starting point, assumptions and scope.
For a phased launch, the plan must identify which activities can begin at each stage and which remain subject to registration, authorisation or other requirements.
The Team and Other Participants
JFC's team coordinates the legal work included in the engagement. The proposal identifies the responsible professional and how communication will be handled.
Accounting, audit, technology and banking work may involve your team or independent providers. We define those responsibilities alongside the legal work so that the launch plan reflects the people and information it depends on. You can also meet our team.
Working With Foreign Counsel
We can coordinate the Argentine legal work with your in-house team or advisers in other jurisdictions. The engagement defines responsibilities, information needs and communication for the project.
Questions Before Getting Started
Do we need to know whether we are a PSP or PSAV before contacting you?
No. Describe the product and its flows. Assessing the applicable framework is part of the work we can agree with you.
Our product combines payments and crypto. How is that assessed?
We review the activities separately and consider how they interact. The project may involve more than one framework, with different responsibilities and dependencies.
Can we launch in stages?
A phased launch may be possible after assessing the activities proposed for each stage. Any activity requiring prior registration or authorisation must meet that requirement before it begins. Submitting an application is not the same as obtaining the required registration or authorisation.
Do you also form the company?
Yes. Corporate formation can be scoped as its own engagement and coordinated with the regulatory work. See our company formation service for the corporate side of the project.
Can our licences and policies from other countries be used?
Existing authorisations, policies and operating experience are useful inputs to the assessment. We review their relevance to the Argentine project and identify the local requirements, documentation and adaptations needed. The effect on preparation time depends on the materials and the work required.
What if our business focuses on lending?
Describe who provides the funds, who receives the loans and what role your platform performs. We assess the applicable lending framework, including OPNFC requirements where relevant, and coordinate it with any payment or corporate work the model requires.
